Abstract
DOI:\xa0 10.1590/2179-8966/2019/39374 Resumen: En este articulo examino los origenes, estructura y dinamicas del trabajo juridico pro bono que hacen los abogados en Brasil. En particular, ofrezco los siguientes tres argumentos. Primero, afirmo que el discurso y practicas pro bono de Brasil son un transplante juridico que no ha experimentado todavia variaciones en el contexto de recepcion. Segundo, senalo que este transplante juridico todavia no se ha enraizado en la cultura juridica brasilena a pesar de las contribuciones que ha hecho a la materializacion del derecho al acceso a la justicia en el pais. Esta debilidad del discurso y practicas pro bono se explica, indico, tanto por causas del contexto cultural, politico y juridico brasileno como por causas relacionadas con las instituciones e individuos que proveen el trabajo pro bono en Brasil. Tercero, y ultimo, argumento que la contribucion que hace a la materializacion del derecho al acceso a la justicia es todavia incipiente. No obstante, al mismo tiempo argumento que las contribuciones que ha hecho el trabajo pro bono en Brasil son una de las bases sobre la cual se puede construir tanto para aumentar los niveles de proteccion del derecho al acceso a la justicia en Brasil como para el reconocimiento y materializacion de las obligaciones sociales que tienen los abogados en las democracias en proceso de consolidacion.\xa0 Palabras clave:\xa0 trabajo pro bono, transplantes juridicos, obligaciones sociales de los abogados, abogados en America Latina\xa0 Abstract: In this article I examine the origins, structure and dynamics of the pro bono legal work done by lawyers in Brazil. In particular, I offer the following three arguments. First, I argue that Brazil s pro bono discourse and practices are a legal transplant that has not yet experienced variations in the context of reception. Second, I argue that this legal transplant has not yet taken root in the Brazilian legal culture despite the contributions it has made to the realization of the right to access to justice in the country. This weakness of pro bono discourse and practices is explained, I argue, both by causes of the Brazilian cultural, political and legal context and by causes related to the institutions and individuals that provide pro bono work in Brazil. Third, and last, I argue that the contribution it makes to the realization of the right to access to justice is still incipient. However, I also argue that the contributions that pro bono work has made in Brazil are one of the bases on which lawyers can build both to increase the levels of protection of the right to access to justice and for the recognition and realization of lawyer’s social obligations in a democracy in process of consolidation like the Brazilian.
