A CONSTRUÇÃO HISTÓRICA DO DIREITO HUMANO À ÁGUA: DA GUERRA DEL AGUA AO RECONHECIMENTO INTERNACIONAL/ THE HISTORICAL CONSTRUCTION OF THE HUMAN RIGHT TO WATER: FROM THE GUERRA DEL AGUA TO INTERNACIONAL RECOGNITION

Abstract

O trabalho analisa o direito a agua, enquanto direito humano, a partir do processo de reivindicacao por esse recurso natural no contexto de privatizacoes dos anos 2000 na Bolivia, tambem conhecido como Guerra Del Agua, das repercussoes desse conflito no processo constituinte boliviano, bem como o reconhecimento da agua enquanto Direito Humano no plano internacional. A partir do metodo materialista historico dialetico, buscou-se perceber como se deu a construcao historica do direito a agua enquanto direito humano, tendo como ponto de partida nao a sintese normativa produzida sobre esse direito, mas o conflito social que gerou esse debate, percebendo quais os novos paradigmas teoricos e juridicos em torno da agua no processo constituinte boliviano. Pode-se concluir que o direito a agua nasce da luta concreta de classes subalternas ou fracoes destas, e que sua materializacao, por outro lado, tambem se condiciona ao potencial de reivindicacao de tais massas. Abstract:\xa0 The work seeks to analyze the right to water, while human right, from the process of reivindication for that natural resource in the context of privatizations of the 2000‘s in Bolivia, also known as Guerra Del Agua, the repercussions of this conflict in the bolivian constituent process, as well as the recognition of the water while Human Right in the\xa0internacional plan. From the dialectical historical materialist method, we sought to perceive how the historical construction of the right to water while human right happened, having as initial point not the normative synthesis produced on that right, but the social conflict that generated this debate, perceiving which are the new theoretical and legal paradigms around the water in the bolivian constituent process. It‘s possible to conclude that the right to water borns of the concrete struggle of subaltern classes or fractions of these, and that their materialization, on the other side, it‘s also conditioned to the potencial for claiming such masses.
