Poder Judiciário, decisão judicial e estereótipos de gênero

Abstract

EnglishThe article s objective is to analyze - in a scenario of the increasing number of female judges - the relation between gender and judicial decision. Based on a literary review about the theme, this paper highlights some conclusions from other theorists about the topic. Then, it explores the reproduction of gender stereotypes in the law and the Judiciary Power. Finally, some judicial decisions are presented to problematize the hypothetical presumption that female judges would have, necessarily, a beneficial view - or less stereotyped – about women in their legal decisions. The achieved results in the literature were inconclusive about the relationship between gender and judicial decision. Besides, it’s important to keep in mind that recently, especially in Brazil, the number of empirical studies on the subject has increased. This research was developed in the Brazilian context, but, in comparatives terms, presents some examples of the Portuguese law – in the legislative and judicial spheres. portuguesO artigo tem como objetivo analisar – dentro de um cenario de ampliacao feminina na magistratura – as relacoes entre genero e decisao judicial. A partir de uma revisao da literatura sobre o tema, o trabalho destaca algumas conclusoes alcancadas por teoricos que investigaram a questao. Em seguida, o artigo aborda a discussao sobre a reproducao de estereotipos de genero por parte da legislacao e do Poder Judiciario. Por fim, sao apresentadas algumas decisoes judiciais, com o objetivo de problematizar uma suposta presuncao de que as juizas, necessariamente, teriam uma visao mais benefica – ou menos estereotipada – sobre as mulheres em suas decisoes. Conclui-se que a literatura sobre o tema nao alcancou resultados uniformes na investigacao acerca das relacoes entre genero e decisao judicial. Ademais, entende-se que seria importante uma ampliacao dos estudos empiricos sobre o tema, especialmente no Brasil, onde o assunto apenas recentemente comecou a ser explorado. A pesquisa foi desenvolvida no contexto brasileiro, mas apresenta alguns exemplos do direito portugues – no âmbito legislativo e na esfera judicial – em carater comparativo.
