PENGATURAN AIR DALAM SISTEM HUKUM INDONESIA

Abstract

ABSTRAK Air memiliki 3 (tiga) fungsi, yaitu fungsi sosial, fungsi ekonomi dan fungsi lingkungan. Sehingga pengaturan tentang air harus melihat ketiga fungsi tersebut. Di sisi lain Indonesia sebagai negara yang kaya akan sumber daya air menghadapi berbagai permasalahan terkait air, mulai dari banjir, kekeringan dan pencemaran. Hukum memiliki peran penting dalam menyelesaikan berbagai permasalahan terkait air. Oleh karena itu penulis tertarik untuk meneliti lebih mendalam mengenai pengaturan air dalam sistem hukum Indonesia. Penelitian dilakukan dengan metode penelitian yuridis normative. Dan hasil penelitian menunjukkan bahwa pengaturan air di Indonesia difokuskan kepada peran air sebagai sumber daya pembangunan ekonomi. Dalam sistem hukum Indonesia, penulis menempatkan air dalam sub sistem hukum lingkungan yaitu hukum sumber daya alam, meskipun demikian seiring perkembangan ilmu pengetahuan, hukum sumber daya air pun berkembang semakin luas dan mewarnai keseluruhan sistem hukum Indonesia. Kata kunci: air; sumber daya air; hukum. ABSTRACT They are 3 functions of water, which is social functions, economic functions and environmental functions. All of regulation related to water should contain three functions of water. On the other hand, Indonesia as a country who had big potential of water resources, was face various problems related with water, ranging from floods, droughts and pollution. Law has an important role in solving various problems related to water. So, the authors are interested in researching more deeply about water regulation in Indonesian legal system. The research was conducted using a normative juridical research method. And the results of the study show that water regulation in Indonesia is focused on the role of water as a resource for economic development. In Indonesian legal system, the author places water in the sub-system of environmental law, namely the law of natural resources, however, along with the development of science, the law of water resources has also expanded and colored the entire Indonesian legal system.
