PROBLEMATIKA PEMBENTUKAN PERATURAN DAERAH (PERDA) TENTANG RENCANA TATA RUANG WILAYAH PROVINSI RIAU

Abstract

ABSTRACT Salah satu Peraturan Daerah (Perda) yang mempunyai fungsi strategis adalah Perda tentang Rencana Tata Ruang Wilayah (RTRW). Akan tetapi penyusunan Perda RTRW ini tidaklah mudah dan berbeda dengan Perda-perda yang lain karena banyak kepentingan yang harus dipertimbangkan. Contohnya adalah dalam penyusunan Perda RTRW Provinsi Riau. Walaupun Perda mengenai RTRW Provinsi Riau telah ditetapkan, penyusunannya memerlukan waktu yang cukup lama dikarenakan banyaknya institusi dan kementerian yang terlibat. Hal ini berbeda dengan penyusunan Perda yang lain. Selain itu, \xa0secara teknis di lapangan ada permasalahan yang harus diselesaikan yaitu menyangkut pengosongan areal yang telah menjadi perkebunan kelapa sawit di kawasan hutan. Hal ini bukanlah pekerjaan mudah karena harus menebang pohon kelapa sawit dengan luasan ratusan ribu hektar. Penelitian ini menggunakan metode penelitian hukum normatif dan empiris dengan data sekunder dan primer. Tujuan penelitian ini adalah untuk mengetahui mekanisme dan permasalahan dalam penyusunan RTRW Provinsi Riau. Kata kunci: pembentukan; perda; tata ruang. ABSTRACT One of the Regional Regulations (Perda) that has strategic function is the Perda on Regional Spatial Planning (RTRW). However, the preparation of this RTRW Perda is not easy and differs from other Perda because there are many interests that must be considered. An example is the preparation of the Riau Province RTRW Regional Regulation. Although the Regional Regulation on the Riau Province RTRW has been established, its preparation requires quite a long time because many institutions and ministries are involved in this matter . This is different compared to the preparation of other Perda. In addition, technically, there are problems in the field that must be resolved regarding the clearance of areas that have become oil palm plantations in forest areas. This is not an easy task because it must cut down oil palm trees with an area of hundreds of thousands of hectares. This study uses normative and empirical legal research methods with secondary and primary data. The purpose of this study was to determine the mechanisms and problems in the preparation of Riau Province RTRW . Keywords: establishment; regional regulation; spatial planning.
