To trust or not to trust? Fiducia e diritti fondamentali in tema di mandato d’arresto europeo e sistema comune di asilo

Abstract

EnglishMutual trust, even if not established in the Union primary law, is a fundamental principle on which the area of freedom, security and justice is built on. The paper analyses the recent case law of the Court of justice on European arrest warrant and common asylum system, structured around it, trying to highlight the tension between mutual trust and protection of fundamental rights italianoLa mutua fiducia, seppur non prevista nel diritto primario dell’Unione, e un principio fondamentale sul quale si regge la costruzione dello spazio di liberta, sicurezza e giustizia. Il presente contribuito analizza le recenti evoluzioni giurisprudenziali della Corte di giustizia in materia di mandato d’arresto europeo e sistema comune di asilo, che su questa fiducia sono imperniati, tentando di mettere in luce la tensione tra mutual trust e tutela dei diritti fondamentali.
