TANGGUNG JAWAB BIRO PERJALANAN WISATA DALAM PERJANJIAN PERJALANAN WISATA (STUDI DI PT. TIGA BIDADARI WISATA, LOMBOK)

Abstract

Ada dua masalah pokok yang diteliti yaitu mengenai hubungan hukum Biro Perjalanan Wisata dengan para pihak dalam perjanjian perjalanan wisata dan Tanggung Jawab PT. Tiga Bidadari Wisata terhadap wisatawan dalam perjanjian perjalanan wisata. Metode penelitian yang digunakan adalah metode penelitian hukum normatif. Hubungan hukum Biro Perjalanan Wisata dengan wisatawan atau konsumen hakikatnya sebagai penjual jasa wisata dengan pembeli jasa wisata dan hubungan hukum Biro Perjalanan Wisata dengan pihak hotel maupun transport ada pada perjanjian atau kontrak yang dibuat oleh para pihak. Tanggung Jawab Biro Perjalanan Wisata terhadap para pihak tidak diatur secara rinci di dalam Undang-Undang. Biro Perjalanan Wisata bertanggung jawab penuh atas keselamatan wisatawan yang melakukan perjalanan wisata berdasarkan paket wisata yang dijualnya. Tanggung Jawab Hotel pada perjanjian perjalanan wisata yaitu atas keselamatan, kenyamanan dan keamanan tamu hotel dan pihak transportasi bertanggung jawab atas keamanan dan keselamatan wisatawan selama kegiatan perjalanan wisata. There is two main problem examined in this research are the legal relations between tour Bureau and the parties in the tour agreement and PT. Tiga Bidadari Wisata responsibilities towards the tourists in tour agreement. Research method used in this research is normative method. Legal relations between the tour bureau with the tourists or consumer principally as seller and buyer of travel services and the legal relations between the tour bureau and hotels and transportation company include in the agreements that have conclude between the parties. The tour bureau responsibilities is not regulate with detailed in law. The tour bureau have a fully responsibilities on tourists safety that have a tour based on his tour package. Hotels responsibilities on tour agreements are safety, convenience and security of hotel guests and transportation company responsiblities are safety and security of the tourists during the tour.
