PRAKTEK ADOPSI ANAK DAN PERAN PEKERJA SOSIAL DALAM PROSES ADOPSI ANAK DI DIY

Abstract

Child adoption in Indonesia has been regulated in Law number 23 year 2002 and other additional regulation. Prospective foster parents have to follow the process and procedure of child adoption. However, in reality there are still many child adoption practices that are not in line with the regulation. Using qualitative research, this paper attempts to describe and explore the practice of child adoption and the roles of social worker in the practice of child adoption in Yogyakarta. The result shows that in the process of child adoption in Yogyakarta there are several issues that come up; law dualism between District Court and Religious Court, administrative issues, and religious differences between propective parents and the child. Moreover, social workers play significant role in the process of child adoption as administrative role, social advocacy and mediator. Di Indonesia adopsi anak sudah diatur berdasarkan UU no 23 tahun 2002 dan peraturan lain. Calon Orang Tua Asuh (COTA) harus mengikuti proses dan prosedur adopsi sebagaimana peraturan tersebut. Namun dalam kenyataannya banyak kasus adopsi yang menyalahi UU dan peraturan pemerintah yang ada. Dengan menggunakan penelitian Kualitatif, tulisan ini mencoba mendeskripsikan dan mengeksplorasi praktik adopsi di Yogyakarta dan peran Pekerja Sosial dalam praktik tersebut. Hasil menunjukkan bahwa ada beberapa isu yang muncul seperti dualisme hukum antara Pengadilan Negeri dan Pengadilan Agama, permasalahan Administratif dan perbedaan agama antara COTA dan anak. Penelitian juga menunjukkan bahwa pekerja sosial memainkan peran administratif, advokat dan mediator.
