Hipótesis sobre el tratamiento del concebido según la ética kantiana

 

Abstract


espanolLa teoria moral kantiana ha sido fundamental para el desarrollo del derecho occidental y se considera la base constitucional de muchos sistemas juridicos. La eleccion de su filosofia entre muchas otras no es casualidad, sino que responde a su posicion sobre el hombre, la cual sustenta el concepto de Estado moderno, haciendo de el su centro y fin. En consecuencia es logico que nos cuestionemos por su posicion moral acerca del concebido, pues a pesar que muchos han elegido interpretar que la falta de pronunciamiento del filosofo sobre el tema hace de este un area no kantiana, lo cierto es que no solo si puede ser cubierto por su pensamiento, sino que resulta, hablando en sus terminos, en un deber hacerlo, dado que no puede dudarse de la proteccion que le habria conferido y la responsabilidad sobre ello es urgente, dado que como deciamos la filosofia kantiana conduce los hilos de gran parte del derecho moderno. EnglishThe Kantian moral theory has been fundamental for the development of Western law and is considered the constitutional basis of many legal systems. The choice of his philosophy among many others is not chance, but responds to his position on man, which supports the concept of modern state, making it his center and his end. Consequently it is logical that we question ourselves about his moral position on the embryo, because although many have chosen to interpret that the lack of pronouncement of the philosopher on the subject makes it a non-kantian area, the truth is that not only can it be covered by his thought, but it is, speaking in its terms, a duty to do so, since there can be no doubt about the protection that would have conferred upon him and the responsibility for it is urgent, given that as we said the Kantian philosophy leads the conduction of a great part of modern law
