Intuitive Law versus Folk Law

Zusammenfassung Empirische Studien belegen die Ehrlichsehe oder besser Petrazyckische These, daß neben dem Gesetzesrecht ein ‚lebendes‘ Recht besteht, welches weite Teile des sozialen Lebens (mit-)strukturiert und – durch Abweichung vom positiven Recht – zu dessen Entwicklung beiträgt. Die Bedeutung der auch als intuitives oder informelles Recht bezeichneten Phänomene des realen, lebenden Rechts hängt von der Heterogenität des sozialen Systems ab, in dem sie wirken. Je größer dessen Heterogenität ist, desto mehr nimmt die Bedeutung positiven Rechts zu, weil es eine bessere Steuerung sozialer Konflikte erlaubt. Ein interkultureller Vergleich zeigt, daß die in ‚primitiven‘ Gesellschaften vorliegende ‚Rechts‘-Struktur (folk laws) denen des intuitiven Rechts in der modernen Gesellschaft entspricht. Summary Empirical studies substantiate Ehrlich’s or better Petrazycki’s thesis that there exists alongside the written law a “living law”, which serves to structure many facts of social life and which, through departures from the positive law, contributes to its development. How significant these phenomena of the real, living law are, phenomena also characterized as intuitive or informal law, depends on the degree of heterogenity in the social system in which these phenomena have effect. The greater the degree of heterogenity, the greater the significance of the positive law, for it permits greater control over social conflicts. An inter-cultural comparison shows that the folk laws found in so-called primitive societies correspond to those of the intuitive law in modern societies.

Legal Consciousness as a Research Problem

In order to answer a question fundamentally important for the philosophy of law and jurisprudence, and in order to understand the ramifications of the operation of law in society, it is necessary to study not only the external manifestations of the law (the behaviour of its actors and agents), but also the internal (or internalized) dimension of legal phenomena. It seems plausible that this internal dimension might be penetrated relatively easily through elucidating “legal consciousness” or legal awareness. In that event both empirical research findings and more general reflections on legal consciousness are relevant.1

The Sociology of Law in Poland

Any attempt to outline the development of a branch of science and establish its status in a given society 1 requires the adoption of certain distinct methodological assumptions.

The Prestige of the Law (Preliminary Research Results)

The present paper will deal with two problems which formed the subject of research on the prestige of the law. The first problem was to find out what the Polish population in 1964 thought about the law in general and about the sanctions applied by the law, and to discover the general opinion about the present functioning of the law. Within this framework the aim was to diagnose how the law and some of its institutions are regarded by public opinion at present.
