Electronic land administration system in Malaysia: A proposed review from ICT and legal perspectives

This paper illustrates the scenario of ICT application in land administration in Malaysia in support for effective and efficient administrative processes and development of land in the country. Land administration system, being heavily regulated through the provision of law, is seen as complicated and requires thorough analysis from both the ICT and legal perspectives, if the government were to move towards effective e-government services. A research is, therefore, proposed and preliminary works conducted to investigate the legal provisions and the existing ICT applications in land administration nationwide in order to provide solutions for the government to be better prepared for the future integrated electronic environment.

Harmonising the Attributes of Shariah Compliant Hotel with the Concept of Sustainable Hotel Development Under the Town and Country Planning Act 1976

Hotel industry forms a larger part of halal tourism. If development of a hotel is not properly regulated, it can cause adverse impact to the environment. Adherence to the planning procedures particularly on the aspects of sustainable development can also be considered as part of criteria of a Shariah Compliant Hotel (SCH). As a Khalifah in this universe, it is the responsibility of the men to protect the environment by controlling development activities. This paper will discuss the aspect of harmonising the attributes of SCH with the concept of sustainable development provided under the Town and Country Planning Act 1976. In completing this paper, a qualitative research method was employed. The data for the study was collected using library-based method together with semi-structured interviews with the local planning authority. Observation was also made on the Shariah compliant hotels. The finding reveals that the concept of sustainable development in the planning system should be integrated with three accreditation standards important for the implementation of SCH which are MS1500:2009, MS1900:2005 and MS2610:2015 in order to strengthen the implementation of halal tourism.

Development Plans Role in Promoting Achievement of Sustainable Development: A Case Study of the State of Selangor, Malaysia

Town and Country Planning Act 1976 provides that development plans which play a vital role in controlling the development of the country. The development plans which consist of National Physical Plan, structure plan, local plan and special area plan is aimed to translate the governments policies with regards to countrys development into action so that the development will be more systematic and sustainable. To be a fully developed country by the year 2020, Malaysia has put a great effort to utilize all available resources to boost up its status whether in economy, industry, technology, physical and infrastructure development as well as agricultural aspect. However, this effort posed a great danger to the environment sustainability should the authority failed to monitor and implement a proper development plan as required by the law. Thus, this paper intends to look into the role and impact of the development plans in regulating land use and development in the state of Selangor, Malaysia. It is also the intention of the writer to identify whether the Local Authorities in the State of Selangor implement the policy as stated in the local plan or otherwise. Recommendations and conclusion will be discussed at the end of the article.

The present state of Malaysian environment that has been deteriorating owing to the priority accorded to economic development is rather worrying. This study seeks to examine the role that can assumed by the land planning and development process in improving public health. The research also seeks to identify the improvements that can be made to the Malaysian land use planning and development process as a means of improving public health.

Research for Proposing Incorporation of Environmental Human Rights Principles to Foster Environmental Protection in Nigeria

This research is chosen to address the need to manage issues of environmental degradation and human rights abuses and violations by the multinational companies (MNCs) operating in Nigeria which lead to the people living in the locality to suffer the consequences. If the assertion that health is wealth has a philosophical basis, there is the need to look at the human rights dimension to environmental degradation. This research discusses how environmental degradation affects the enjoyment of guaranteed rights. The regulatory frameworks on environment and MNCs in Nigeria have proven to be inadequate and ineffective in the protection of the rights of the victims of environmental degradation. Research is therefore proposed to investigate and analyze the problems of the existing legal framework on the environment and MNCs in Nigeria. This analysis would assist in the research as to whether human rights offer better remedies and solutions to the victims of environmental degradation in Nigeria and safeguard the interest of the future generations and future sustainable development.

Environmental Protection in Land Use & Development Control System in Malaysia

The importance of environmental protection and conservation has drawn much attention, in Malaysia and internationally, since global environmental problems first emerged as a common worldwide concern at the United Nations Conference on Human Environment since 1972. In 1992, Malaysia participated in the United Nations Conference on Environment and Development (Earth Summit), which upheld sustainable development as its central theme in environmental preservation and conservation. The highlight of the Earth Summit was the adoption of the Rio Declaration, which stipulates 27 basic principles to harmonise environment with development. Agenda 21, a specific implementation plan, was also established by the Earth Summit, followed by the establishment of the Commission on Sustainable Development under the auspices of the United Nations Economic and Social Council to evaluate and monitor the implementation of the Rio Declaration and Agenda 21. The general belief that development and environmental protection are opposed to one another where priority is given to the economic development without due consideration to the environment may no longer be valid. Malaysia is also moving on to encourage proper land use control measures and legislation in carrying out physical development towards an integrated approach in environmental planning and management, thus ensuring sustainable development. Simple as it sounds, the concept is in fact a demanding one in the light of expanding population and diminishing non-renewable resources such as minerals, oil and gas. In many developing countries like Malaysia, there is a tendency to accord greater emphasis on employment generation and income improvement, to the extent that environmental concerns are often ignored or suppressed as a result of socio-economic pressures. There is also increasing awareness that many of the present day pursuit of economic progress are occurring at the expense of the environment and hence are inherently non-sustainable. This has resulted in many cases where the environment has deteriorated to such an adverse level that the remedial repair costs are exorbitantly high. There is an urgent need therefore to identify appropriate development strategies which will aim at achieving developmental goals through a combination of economic efficiency and environmental conservation. This article seeks to examine the existing legal, regulatory and institutional framework for land development and its role in facilitating the integration of environmental considerations so as to promote sustainable development in Malaysia.

Identifying and overcoming the risk of fraud in the malaysian electronic land administration system

This paper attempts to provide a brief research report in risk management and security areas pertaining to threats due fraud in the Malaysian Electronic land administration system. Analyses of potential threats are provided based on evidences from various past researches and working papers, documentations, and field visits. Based on the findings, the researchers classified and described fraud existence, and suggested means of which such threats can be reduced through appropriate use of technology, policies, and strategies.
