The Swiss Technology Assessment Project on Xenotransplantation

ABSTRACT: The Swiss Technology Assessment (TA) project on xenotransplantation is intended to study the opportunities and risks of this technique, recognizing the input of those involved in and those affected by it. This also implies taking into account the clinicoscientific, social, ethical, economic, and legal aspects. The situation in Switzerland is analyzed in depth, with reference to the acceptance, ethics, and existing federal legislation pertinent to xenotransplantation. Apart from consultation with experts from various specialized areas, a written questionnaire was sent to more than 100 organizations, institutions, companies, and individuals. The resulting assessments range from clear approval to complete rejection of the notion of xenotransplantation. Even acceptance was granted only on condition that criteria such as security (minimum risk of infection) and respect for human dignity and animal protection issues are respected. Such criteria are generally accepted, but if concrete conclusions must be drawn, we must recognize that opinions vary in todays discussions on ethics in Switzerland. It is commonly agreed that animals are not objects, but their precise status is not clear. Moreover, there are no patented ethical “recipes” for handling risks.

Beihilfe zum Suizid: grundsätzliche Überlegungen, rechtliche Regulierung und Detailprobleme

Mit diesem Beitrag möchte ich auf den Aufsatz von Marcel Bahro und J. Strnad reagieren und zugleich einige Elemente der neueren Sterbehilfediskussion diskutieren, so wie sie sich in der Schweiz manifestiert haben (vgl. vor allem [5]). Die Perspektive, aus der ich die Argumente und Gegenargumente problematisieren werde, ist sowohl die des Fachethikers mit prinzipieller Reflexion und Argumentation, als auch die eines aktiven Bürgers mit der Möglichkeit, an den Arbeiten einer Fachkommission des schweizerischen Justizdepartementes und somit auch an ersten Verrechtlichungsversuche in diesem spezifischen Bereich teilzunehmen. Diese Tätigkeit verlangte und verlangt ebenso eine klare Sensibilität für Grundsatzfragen als auch die Fähigkeit, Detailprobleme in einen größeren Kontext einbetten zu können. Da der Beitrag von Bahro und Strnad eine Detailproblematik behandelt, wird meine Auseinandersetzung mit ihm vor allem das rechte Verhältnis zwischen Teilproblemen und Gesamtperpektiven beleuchten und problematisieren. Die Tatsache, dass Ärzte und Ärztinnen vor allem mit Aktivitäten von Sterbehilfevereinigungen konfrontiert sind, macht die Auseinandersetzung umso komplexer, da an dieser Stelle sowohl prinzipielle Auseinandersetzungen als auch andere Arten von Konflikten, mitunter gesellschaftliche und berufliche, miteinander kollidieren. Es gilt also an dieser Stelle die Besonderheit einiger Probleme, wie eben die Beihilfe zum Suizid bei psychisch Kranken wahrzunehmen, und gleichzeitig den Sinn für das Ganze nicht aus den Augen zu verlieren. Alles hat mit allem zu tun, aber dieses Ensemble von Beziehungen ist jedesmal neu zu entdecken und ethisch zu bewerten.

Ethics, Law and Legislation: The Institutionalisation of Moral Reflection

This paper describes the different dimensions of the relation between moral reflection and legislative processes. It discusses some examples of the institutionalisation of moral reflection. It is argued that the relation between ethics and law is still an actual and relevant question. Ethics also has to reflect on its own role in political life. The paper defends the relevance of a theological perspective on the relation between law and ethics. In the last part it is argued that the modality of relation between ethics and law depends on the specific character of social domain.

1. Die programmatische Absicht, welche die Herausgeber und die Redaktion der Zeitschrift von Anfang an beabsichtigt hatten, war und bleibt korrekt. Das behaupte ich, obwohl ich nicht zu der „Zunft“ der Mediziner gehöre. Beiträge aus der Feder von Medizinern und Medizinerinnen und solche, die von Philosophen oder Theologen verfasst wurden, sind sowohl im Stil verschieden als auch in der Art und Weise, die moralischen Probleme dieses Lebensbereiches anzugehen. Ich habe aber den Eindruck gewonnen, da zumindest ein gegenseitiger Lernprozess in Gang gekommen ist. Dies wurde auch durch den Beitrag der juristischen Reflexion erleichtert, welche sich ebenfalls punktuell in der Zeitschrift gemeldet hat. Eine gewisse Einseitigkeit in diesem Dialog der Disziplinen ist durch die „bundesrepublikanische Zentriertheit“ vieler Beiträge gegeben. Mit diesem kritischen Hinweis möchte ich aber nicht die These vertreten, daß vermehrt Stimmen aus Österreich und aus der Schweiz in der Zeitschrift zu veröffentlichen wären, sondern daß die Diskussion der Probleme vermehrt in einer gesamteuropäischen und internationalen Atmosphäre geschehen sollte. Am Beispiel des Themas „Sterbehilfe“ hat man sehen können, daß zwar die holländische Diskussion und Reglementierung angemessen dargestellt worden ist, Diskussionen und Auseinandersetzungen aus anderen Sprachräumen (wie etwa aus dem romanischen Sprachraum im allgemeinen) eher vernachlässigt bis ignoriert worden sind. Hier ist ein Nachholbedarf durch Hinzuziehung von Korrespondenten aus dem Ausland zu erfüllen.

COMING TO CONSENSUS: AN ETHICAL PROBLEM IN LAW AND POLITICS - ILLUSTRATED BY THE EXAMPLE OF REPRODUCTIVE TECHNOLOGIES*

The necessity of making consensus an object of study in social science research, legal philosophy, and ethics is a specifically democratic achievement and duty at the same time. Pre-democratic forms of society have no need to make an issue of the processes involved in coming to a consensus precisely because these societies hardly ever rest upon a consensus emerging from such a procedure. For all of us, however, the search for a rational strategy of consensus, primarily in ethical questions, poses the only feasible alternative to bellum omnium in omnes.1
