Paternalism is a salient feature of most children’s lives. This paper explores a specific version of paternalism, namely future-oriented paternalism. Future-oriented paternalism is directed to presumed valuable goals for the child’s later life as an adult such as autonomy and education. This paper analyses the normative implications of future-oriented paternalism. In a first step it is pointed out that future-oriented paternalism is often understood as entailing what can be called the ‘instrumental conception of childhood’. In a second step this conception of childhood is critically examined and rebutted. Hence the paper asks in a third step for a refined version of future-oriented paternalism that doesn’t make use of the instrumental conception of childhood.

In diesem Beitrag wird die Frage danach, ob es legitim ist, Kinder vom allgemeinen Wahlrecht auszuschliesen, in einem allgemeineren Kontext betrachtet, indem zunachst thematisiert wird, welche Rechte Kinder allgemein haben. Anschliesend wird die auf Harry Brighouse zuruckgehende Unterscheidung zwischen Wohlfahrts- und Handlungsrechten eingefuhrt und kritisch hinterfragt. Es zeigt sich, dass Brighouse Kinderrechte problematischerweise als reine Wohlfahrtsrechte definiert, bzw. dass Kinder auch Handlungsrechte haben. Allerdings gibt es gute Grunde dafur, das allgemeine Wahlrecht nicht zu den Handlungsrechten von Kindern zu zahlen.

Physicians are sometimes confronted with cases of child-maltreatment where they suspect that parents have harmed their child. In such cases physicians are typically confronted with two conflicting duties: on the one hand they have to report cases of child-maltreatment to the youth welfare office. On the other hand they are bound by their professional confidentiality which entails that they have to keep intimate information especially from public institutions like the youth welfare office. This paper points out that this situation is particularly awkward in cases of insufficient evidence where still parents seem to have maltreated their child. Such cases are called cases of family-dilemma because both duties apply at the same level. This paper firstly analyses the structure of the family-dilemma and secondly discusses a possible solution to it. The upshot of the discussion is that a solution of the family-dilemma is only within reach when core values of the liberal society like ‘parental autonomy’ and ‘privacy of the family’ are redefined.

ZusammenfassungOb eine sportliche Leistung anerkannt wird, hängt maßgeblich davon ab, ob sie im Einklang mit Werten steht, die wir für wesentlich für den Sport halten. Die philosophischen Standardargumente gegen Doping im Sport behaupten eine Unvereinbarkeit von Doping mit Werten wie Fairness, Gesundheit oder Natürlichkeit. Ich möchte im Gegensatz zu diesen Argumenten eine grundsätzliche Unvereinbarkeit von Doping mit dem Wert eines nachhaltigen Umgangs einer Person mit sich selbst behaupten. Wer dopt, so meine These, folgt einem verabsolutierten Leistungsdenken, was aus ethischer Perspektive kritisiert werden kann, wenn man den Wert der Nachhaltigkeit als ethischen Wert annimmt.AbstractDefinition of the problem We accept performances in sports only if they are liable to certain alleged values in sports. Philosophical standard arguments against doping typically claim the incompatibility of doping with values like fairness, health, or naturalness. Arguments In this paper, the author supports the thesis that doping does not contradict any of these values but is instead incompatible with the value of sustainability applied to the relation of a person to him- or herself. Conclusion It is argued that doping endorses a one-sided focus on performance that, in turn, can be criticized from an ethical point of view, if one accepts the value of sustainability as an ethical value.
