E-Commerce in the Single Market Context – The Invisible Framework

The paper explores the Digital Single Market, which seems to be invoked in almost all Internet related EU documents but is, in fact, a complex and confusing concept developed in different individual contexts by different Directorates General. The Digital Single Market-dimension in the EU is split between the telecommunications framework and the content/services framework, but the reality of Internet use increasingly requires convergence. The paradox is that the Digital Single Market, by the EU’s own admission, remains an unachieved goal while at the same time functioning relatively smoothly in a number of areas. The truth may very well be that other paradigms will be more useful in the future development of an Internet-based society. Cross-Border Litigation and ADR Mechanisms in Disputes Concerning Mobile Computing in the EU

The aim of this paper is to discuss briefly how the EU rules on jurisdiction, choice of law and alternative dispute resolution in civil and commercial matters operate in the context of mobile computing. The article first looks at rules on jurisdiction in commercial disputes, both between businesses and between businesses and consumers. It then discusses the choice-of-law issues applicable to mobile computing. Finally, there is an examination of alternative dispute resolution as an alternative to regular courts in transactions involving mobile computing.
