SOCIAL, ECONOMIC AND CULTURAL RIGHTS AND CIVIL AND POLITICAL RIGHTS*

Este artigo aborda os direitos sociais, economicos e culturais e os direitos civis e politicos, sob a perspectiva do Direito Internacional dos Direitos Humanos. Analisa a concepcao contemporânea dessa questao a luz do sistema internacional de protecao, desvendando seu perfil, seus objetivos, sua logica e sua principiologia e questionando a plausibilidade de uma visao integral dos direitos humanos. Em um segundo momento, analisa os principais desafios e perspectivas para sua implementacao, sustentando que esse enfrentamento e essencial para que os direitos humanos assumam seu papel central na ordem contemporânea.This essay deals with social, economic and cultural rights and political and civil rights within the context of international law on human rights. To this end, it reviews the contemporary conception of this issue in the light of the international system of protection, evaluating its profile, its objectives, its logic and its principles, and questioning the feasibility of an integrated vision of human rights. This is followed by an evaluation of the main challenges and prospects for the implementation of these rights, claiming that facing this challenge is essential to ensure that human rights will take on their central role in the contemporary order.

Proteção dos direitos sociais: desafios do ius commune sul-americano

This paper discusses social rights by focusing on their protection in the international and regional context. It describes and analyzes the difficulties and challenges of the implementation of social rights in South America with the aim of building a regional constitutionalism whose foundation is the ius commune . For this purpose, the article presents the historical background of the affirmation of human rights and social rights as well as structural notions of the systems of their protection both at the global level and regional level in order to provide within the latter, especially in the South America, the challenges of the ius commune .
