1 - Avendo il compito di presentare gli Scritti, debbo provare ad andare oltre l’affetto, oltre la commozione. Anche perche proprio la professoressa Folliero non mi avrebbe certo perdonato smarginamenti.E allora, desidero anzitutto ringraziarvi, ringraziare questa Universita, i Colleghi di questa Universita e ringraziare in particolar modo l’ADEC nella persona del Presidente e dei componenti del Direttivo per avere pensato a questo Atto accademico in memoria della professoressa Folliero e avervi incluso, affidandomela, la presentazione degli Scritti a Lei dedicati. Ringrazio Gianni Cimbalo, per la ricostruzione puntuale e avvertita del profilo scientifico della studiosa, il toccante ricordo della persona e per le emozioni che ha rinnovato, credo non soltanto a me.

Il favor fiscale dell'ente ecclesiastico-religioso "imprenditore sociale" nella prospettiva del divieto europeo di aiuti di Stato: conferme problematiche dalla recente giurisprudenza UE in tema di esenzione ICI/IMU

In 2010, the European Commission opened an in-depth inquiry on exemptions from the municipal real estate tax (ICI) that Italy has granted to non-commercial entities performing specific activities. The Commission concluded that these exemptions were incompatible with the european rules on State aid but it has not ordered Italy to recover the aid from the beneficiaries because the Italian authorities have demonstrated that, in this specific case, recovery would be absolutely impossible. At the same time, the Commission found that the new italian law on the taxation of real estate, in which ICI has been replaced by IMU, is in line with EU state aid rules. The Court of Justice of the European Union has recently rejected the applications for the annulment of the decisions of the European Commission. The Author focuses on these decisions of the Court, particularly in the light of the possible evolution of the legal status of the religious entities which are interested to perform social activities such as non-commercial entities or non-profit organizations

The Interface between End-of-Life Care and Religious Rights: Legislation of a Christian or a Secular State?

There is no doubt that legal scholars engaged in the study of what the Italian literature currently defines as ecclesiastical law, or - if we prefer to have recourse to an expression which is perhaps broader and, consequently, less conditioning - of the relationship between law and religion, can find in bioethics generally and, specifically, as in our case, in end-of-life care related issues. This chapter analyzes the Italian draft law on advance directives in the light of this dual characterization. It is diffficult not to realize that the subject of advance directives regulation constitutes for the Religion of more established presence in Italy, the Catholic Church, important field to reafffirm its right to intervene in the dynamics of the relationships between law and politics. The chapter concludes reverting to the basic question considered in the title of the chapter: does the draft bill represent the legislation of a Christian or a Secular State?.
