Abstract In this paper, we consider the contract forms for optimal tenant protection in rental-land and rental-housing agreements. The optimal contract must protect a tenant’s investment return from the rent extraction by the landlord while not restricting the landlord’s efficient alternative use of the property. In this paper, we argue differently for rental-land contracts than for rental-housing contracts. In a rental-land contract, the tenant is the investment party, whereas in a rental-housing contract, the landlord is the investor in the building. Nevertheless, we show that the optimal contract has a fixed-term tenant protection for both contracts.
