Belgian Federalism after the Sixth State Reform

Abstract This paper highlights the most important institutional evolutions of Belgian federalism stemming from the implementation of the sixth state reform (2012-2014). This reform inter alia included a transfer of powers worth 20 billion euros from the federal level to the level of the federated states, a profound reform of the Senate, and a substantial increase in fiscal autonomy for the regions. This contribution critically analyses the current state of Belgian federalism. Although the sixth state reform realized important and long-awaited changes, further evolutions are to be expected. Since the Belgian state model has reached its limits with regard to complexity and creativity, politicians and academics should begin to reflect on the seventh state reform with the aim of increasing the transparency of the current Belgian institutional labyrinth.

Élargissement et diversification du contrôle juridictionnel belge des actes administratifs: appel pour l’utilisation du droit comparé et la création d'une vision claire

Suite a l’accord institutionnel sur la 6eme reforme de l’Etat belge (2011), la juridiction du Conseil d’Etat et des autres juridictions administratives sera elargie aux consequences de droit prive des recours en annulation. Conformement aux intentions prevues de l’accord, la reforme sera materialisee par le biais d’une modification de l’article 144 de la Constitution. La reforme annoncee contraint la prise en compte de nombreuses implications qui seront analysees dans cette contribution. Il est en outre recommande de reflechir quant a un elargissement continu et a une diversification des competences en matiere de jugement du juge administratif. Pour finir, les decideurs doivent developper une vision claire concernant le renouvellement du pluralisme juridictionnel actuel ou l’evolution vers le monisme. Le droit compare fonctionnel offre des perspectives interessantes afin de repondre a des questions relatives a la mise en application des reformes.
