Abstract In this article the authors argue that the historically specific laws and regulations with regard to religious groups in Belgium, Britain and the Netherlands provoke different political reactions to the presence of Muslims. These laws and regulations also affect — to some extent — the ideological representation of Muslims. The reverse process of laws and regulations being changed by politico‐ideological mobilisation also takes place, but the picture is less clear. Sometimes the law has been changed to entrench the norms of the receiving society and to suppress ‘undesirable’ Muslim behaviour. But at other times existing laws have been changed or circumvented to enable Muslims to institutionalise. The ideological representation of Muslims does not necessarily depend on religious characteristics, but may also turn on ethnic or socio‐cultural characteristics.

In recent decades, the migration of population from east to west in Europe has mainly been ethnically-based, with migrants having or claiming a common culture, religion, or language, or a common ancestry with the population of a western country moving to that motherland. The largest population movement of this kind has been ethnic Germans from Poland, Romania, and the former Soviet Union migrating to Germany. However, during the late 1980s, the rapid increase in Germany in the number of asylum seekers, family members of migrant workers, Germans from the German Democratic Republic, and ethnic Germans from Eastern Europe led the German government to introduce a series of measures to restrict immigration. This paper describes the efforts of successive German governments to regulate and control the immigration of ethnic Germans from Eastern Europe. The effect of those instruments upon the migration movement and the relative effectiveness and ineffectiveness of the policy instruments are explored through comparing migration from Poland, Romania, and the former USSR. Hypotheses upon the limits of governmental efforts to control migration and some typical characteristics of ethnic migration influencing policy-making are discussed.
