The study makes a brief review of the contemporary evolution in the Developing Countries by using as a reference what Max Weber called the exceptionality of the European evolution, which has represented the great peculiarity around the world: the specialization of roles and functions, the rationalization of daily life and the application of these principles to the fields of knowledge, law, administration and economics, and that have had to do directly with the generation of prosperity in the long term and in favor of wide social layers. On the other hand, the processes of modernization in the Developing Countries try to create an original and own order that helps to establish a solid identity distinguishable from other politic-social regimes. But the global result is a model of mediocrity and imitation. Is this imitation of the western paradigm a mandatory law for evolution? The interpretation of this asymmetric relation is guided by the prudence and based on the experience which judges according to what is probable, feasible and reasonable and that does not exempt the need of emitting appraising judgments?En su gran mayoria, los casos de incesto no se develan, la situacion abusiva se repite de una forma u otra y la nina queda encerrada en su terrible secreto. Por otro lado en los escasos casos que pasan a mano de la justicia, el padre esta botado en una carcel donde suele estar maltratado por los otros presos, y la nina vive una culpabilidad intensa por este mismo hecho. La mediacion penal, un proceso judicial llevado a cabo bajo la responsabilidad de un fiscal, permite, sin ocuparse de dictar sanciones, restablecer una relacion de palabras entre la hija y su padre, y de este modo ayudar a una re-inscripcion de ambos en una sociedad fundada en la Ley Universal de Prohibicion del Incesto.
