IN THE LIMITED FIELD OF HIGHWAY SAFETY THE CONSEQUENCES OF LEGAL SANCTIONS AND DETERMINATION OF THE CONSEQUENCES ARE EXPLORED. To shift our concentration from matters of internal organization to those of the political setting moves us toward a long-needed reintegration between professional analysis of regulatory administration and the liveliest currents of general empirical political theory. Among the latter currents, one of the most promising consists of Theodore J. Lowis categorization of policies and related political processes into distributive, regulatory, constituency, and redistributive types. According to Lowi, each of these types carries with it a distinctive pattern of political activity. Private citizen litigation has often been mentioned as the most direct method of allowing citizens actively to pursue a quality environment. A variety of proposals have been introduced and attempted both in state legislatures and in Congress. With the proposed House and Senate legislation in mind, this Article warns that the major proposals presently being considered may ultimately prove to be detrimental rather than beneficial to the cause of environmental preservation.

In addition, the latest edition features revised materials on the European legal approach to include recent codifications in the Rome I and II conventions. This edition continues the tradition of organizing the teaching of conflicts around the broad themes reflected in different intellectual approaches to the problem.
