The Industrial Relations Counselors and the Professional Status

Can we really look upon the Industrial Relations Counselor as a professional? It is significant that the question is still being raised even within the new Society of Industrial Relations Counselors which, for almost two years, has enjoyed a fullfledged legal status like other older professional groups. The purpose of this working paper is not to prove at any cost that the question should be answered in the affirmative. Quite the contrary it is in no way based on any preconceived idea, but simply attempts to furnish the principal elements of an answer to our question and to provide food for thought on the criteria of the professional status insofar as they apply to the Industrial Relations Counselors.

This article is an attempt at probing into the fundamentals of arbitration. It deals with the NATURE and SCOPE of the process of arbitration seen as an extension and an ingredient of collective bargaining, as well as a substitute for strike action. It also analyzes some of its essential PURPOSES, FUNCTIONS, and PREREQUISITES in a free society. It examines the MANAGEMENT-RIGHTS ISSUE in terms of the SPECIFIC FUNCTION OF MANAGEMENT. It then sets EQUITY and PAST PRACTICE against the language of the agreement. And finally, it briefly defines the ROLE OF THE ARBITRATOR and describes SOME RECURRENT DIFFICULTIES which threaten to bog the arbitration process.

In the last analysis, the firmest and deepest foundation of management rights is the need for an efficient coordination of multifarious activities and often divergent interests, with an aim to achieving the basic purpose of the business concern. Efficiency, however, is essentially a value whose definitions are all the more numerous and varied as science, in its present applications to industry, cannot lay claim to absolute certainty and accuracy. And even if it could, this would not alter in any way the political nature of decision-making. Such considerations lead to a re-examination of the notions of collective bargaining and joint management, as well as they induce new thinking on the specific function of management, which reaches beyond decision-making into the realm of coordination of means, activities, interests, and bargains.
