Abstract The terms of reference of a health commissioner appointed to investigate complaints about the health services may well resemble those laid down for the Parliamentary Commissioner for Administration. If they do, the health professions need not be apprehensive about the innovation. A health commissioner may find it difficult to distinguish between clinical errors and maladministration, but the task will not be impossible.

Despite fiscal stress, public confidence in the National Health Service (NHS) remains strong; privatisation has not hollowed out the service. But if long term challenges are to be overcome, pragmatism not rhetoric should be the guide.
