Reasoned decisions in construction contracts evaluation

Abstract Preparation of an agreement has a great influence on economic success of both parties and on their behaviour in order to increase their profits and to protect themselves against a possible loss. It is important to use technological innovations in construction contracting. Even when the contractor is selected and the price and work terms are negotiated, it is possible to choose several variants of agreements. The aim of this article is to develop a hierarchical model of criteria of a construction contract agreement based on their functions. Construction contract agreements can be concluded, evaluated and compared on the basis of this model. The model forms the basis of decision support system for analysis of construction contracts. Decision support system created on the basis of the presented model can be very useful and helpful in construction contract agreement and can be widely implemented in different construction sectors.

Analysis of criteria system model for construction contract evaluation

Preservation of Healthy and Harmonious Residential and Work Environment During Urban Development

The article discusses densification of fully urbanised territories, which causes deterioration of living conditions for tenants of neighbouring houses (third parties) due to the negative impact of construction on local environment. Specifically, detection of fundamental right violations during territorial planning is in focus, because not only third parties but also future tenants of the house being constructed suffer loss of healthy and harmonious work and recreational environment as a direct result of such violations. A classifier of fundamental right violations during territorial planning was developed for that purpose. The judicial practice was analysed; persons authorised to contest environmental violations under the Law on Administrative Proceedings and the scope of their authorisation were determined.

Modelling the process for defence of third party rights infringed while imp lementing construction investment projects

Abstract The article analyses the influence of third party rights infringed during construction planning for implementation of an investment project. It analyses the process for defence of third party rights infringed during territorial planning. The focus in this process is on third party rights and opportunities to learn about possible infringement of such rights. An analysis of detailed territorial planning procedures is also provided. The model of the proceedings of a dispute on possibly infringed third party rights has been developed. Modelling a dispute between investors and third parties was performed along with creation of the tree of behaviour variants of dispute parties. The model has been developed considering possible behaviour of the parties.

The risks and liability of participants of a construction process for defects of building products

Summary Sharing of the risk and liability is one of the most important functions of construction contracts. Proper sharing of the risks and liability between the parties of construction contract has a rather big influence on efficiency, quality, and probability of arising disputes between the parties of construction contract in construction projects. A lot of risk exists during the fulfillment of construction projects. One of those risks is the risk of defects of building products. The question of the liability of the parties of construction contract for inappropriate quality of the construction production caused by a bad quality of building products mainly depends on sharing of the risk of defects of building materials in the construction contract. Some aspects of the mentioned risk and liability of the parties of the construction contract might be set by mutual agreement in the construction contract.
