Emerging Questions for Emerging Technologies: Is There a Law for the Nano?

Nanotechnologies are a rapidly growing field of researches and applications. Their interdisciplinary scope, as well as the wide range of products they permit, qualified them, early, as enabling or general purpose technologies [1]. Almost all the fields of social life, from research, innovation, work safety, health, consumption, etc., to waste treatment, are, thus, affected by their development. These fields are already framed by legal norms. Thus, a rapid answer to the question we have raised might be, yes, there is plenty of law for the Nano [2].

RésuméLe développement actuel des rfid suscite un certain nombre d’inquiétudes dont certaines seulement peuvent être appréhendées par une normalisation technique. La protection des données personnelles, notamment, va certainement devoir évoluer, confrontée aux potentialités de quasi-invisibilité et à la puissance de ces systèmes. Nous nous proposons, après une rapide présentation de cette nouvelle technologie et de ses principales caractéristiques, en termes de contenu informationnel notamment, d’interroger la pertinence et les évolutions envisageables d’une partie de notre droit positif à son égard.AbstractToday’s rfid expansion makes waves. Only a few of these concerns can be technically regulated. The French’s privacy and personal data protections, especially, may be changed by these near-invisible and powerful technologies. After a short introduction and in consideration of this new technology and its informational contents, we will try to evaluate the relevance and the possible evolutions of our Law.
