Der angemessene Kostenmaßstab für Terminierungsentgelte ‚Pure LRIC‘ vs. ‚KeL‘

ZusammenfassungIm Jahr 2009 veröffentlichte die EU-Kommission eine neue weitreichende Empfehlung (2009/396/EG) bezüglich der Regulierung der Festnetz- und Mobilfunk-Terminierungsentgelte in der Europäischen Union. Wesentliche Unterschiede zur bisherigen Praxis in Deutschland, die auf dem sog. ‚KeL‘-Verfahren beruht, bestehen vor allem darin, dass es zum einen zu einer Harmonisierung der Zustellungsentgelte über alle EU27-Länder hinweg kommen soll. Zum anderen werden bei Anwendung des neuen Kostenstandards, dem sog. ‚pure LRIC‘-Ansatz, Terminierungsentgelte lediglich auf Basis der variablen Kosten festgelegt. Somit bliebe die Berücksichtigung von Gemeinkosten außen vor. Ziel dieses Arbeitspapiers ist es daher, die Vor- und Nachteile der europaweiten Angleichung der Terminierungsentgelte und der unterschiedlichen Kostenansätze ‚pure LRIC‘ und ‚KeL‘ ökonomisch aufzuzeigen, um anschließend Regulierungsempfehlungen abzuleiten.AbstractMotivated by the new extensive recommendation (2009/396/EG) by the EU Commission that affected the regulation of fixed and mobile termination rates in the European Union the paper analyzes the appropriate cost standard for termination rates. In particular, the substantial differences to German regulation based on the so-called ‘KeL’ approach are considered. The new recommendation demands harmonization of termination rates across all 27 EU countries. Moreover, the regulatory standard recommends the implementation of ‘pure LRIC’, termination rates that are calculated — in contrast to the existing regulation — solely on the basis of variable costs, which does not consider joint and common costs. Given this background, the paper identifies advantages and disadvantages of the different costs standards ‘pure LRIC’ and ‘KeL’, as discussed in the economics literature. Finally, based on these results, recommendations for implementation of cost standards are drawn.
