Considering the contemporary debate on themes involving the Brazilian forest legislation, the present article explore correlations between economics factors and the variation in the proportion of protect areas on private ownerships, legal reserve, across the municipal districts of a Brazilian Stated, Sao Paulo. The main finding of the study is point that main argument used to explain the noncompliance to the law and change the valid environmental legislation, was not support.

Reserva legal es una figura de proteccion de caracter obligatorio para tierras privadas brasileras y importante para la conservacion de la biodiversidad. Sin embargo, su cumplimiento no es efectivo y razones economicas justifican la falta de mantenimiento. Como alternativa de regulacion, la ley permite al propietario rural compensar la reserva legal fuera de los limites de los inmuebles rurales. Este articulo analiza las principales implicaciones economicas y ambientales del mecanismo de compensacion, considerando los criterios validos para su norte amiento y los aspectos funcionales de las reservas legales. En conclusion, la compensacion puede traer beneficios reales para la naturaleza al incentivar la manutencion de areas naturales en tierras privadas con menores costos de oportunidad y de implementacion. Con esto, la amplitud de la unidad territorial en la cual son permitidos los intercambios, establecidos por medio de la ley, son fundamentales para evitar que intereses economicos prevalezcan sobre los beneficios ambientales.

The National Environment Policy aims to reconcile economic and social development with environmental quality and has several instruments to address environmental issues within the decision making processes. Thus, the discussion about the location of activities is an important step in the evaluation of the environmental acceptability of aparticular activity, even though the systematic procedures do not require neither to the entrepreneur or to the government studies of sitting alternatives. This paper presents the integration of technical, environmental and social criteria in a landfill sitting study, in order to present a systematic integration of environmental factors and applies in a case study in Sao Carlos, Brazil. The results allowed the development of an environmental impact statement more focused on significant impacts and the participation of segments of society at early stages of projects development.
