El estudio del Ministerio Fiscal presenta ciertas dificultades derivadas de su peculiar evolucion historica, su naturaleza juridica. La importancia que ha cobrado en las modernas democracias como institucion de defensa de la justicia y, especialmente, de los derechos fundamentales dista mucho de su origen como institucion historica claramente vinculada al Rey y cuyas funciones se centraban inicialmente en la defensa del patrimonio regio. Progresivamente, la institucion del Fiscal cobro importancia en el marco de la Administracion de Justicia hasta llegar a ser un elemento fundamental de la misma. La Constitucion de 1812 no recoge una regulacion especifica de la institucion del Fiscal como tambien sucedio con constituciones posteriores, a excepcion de algunas referencias contenidas en la Constitucion de 1845 y 1876 en relacion a la posibilidad de que los fiscales fueran senadores. Sin embargo, durante el periodo de vigencia de la Constitucion de Cadiz diversas normas regularon la figura del Fiscal y la creacion del Supremo Tribunal de Justicia en 1812, al que se incorporaron dos Fiscales, es uno de los hechos mas significativos de este periodo. En el periodo «gaditano» se sentaron las bases para una regulacion posterior que llevo a la consolidacion de la institucion avanzado ya el siglo XIX. The study of the Prosecutor presents certain difficulties because of its peculiar evolution throughout the history and its legal nature. In the current democracies this institution promotes justice and, in particular, the protection of fundamental rights. Rather, its functions used to be linked to the King and the defense of the Crown patrimony. The institution played an increased role within the judiciary, down to become one of its essential elements. The 1812 Constitution does not regulate specifically the Prosecutor. Neither did most later constitutions, except the 1845 and 1876 texts, which allowed the prosecutors to become senators. However, as long as the Constitution of Cadiz was in force different laws regulated the institution of the Prosecutor. The creation of the Supreme Court of Justice in 1812, joined by two prosecutors, is one of the most remarkable facts in this period. In fact, the Cadiz period laid the foundations for a later regulation consolidating the institution in the late 19th century.

This study reflects on patient status. Both States Laws and international and supranational laws have respond to changes operated in health sciences, incorporating specific norms related to hu - man rights. Dignity and individual freedom concepts are analyzed as necessary basis for patient status and personal freedom manifested in the field of biomedicine is defended by a new right: the right to physical self determination, which defines the field to improve decision making faculties, protected by law and that allows the person to decide, choose and select what to do or not to do with respect to questions and situations that affect his/her physical reality, his/her corporeity.This study reflects on patient status.
