Compensation and support for illness and injury

Reporting the findings of a large national survey in the United Kingdom, this study examines different systems of compensation and support for the injured, ill, or congenitally handicapped and their families. The authors assess the roles of government agencies, local authorities, employers, and informal organizations in providing such services as social security, criminal injuries compensation, sick pay, and private insurance. The work will be of interest to lawyers, government officials, social security officers, and all others working with people seeking compensation for accident and injury.

Die U S.-amerikanische Literatur zum Recht der Gesellschaften und Konzerne ist ungewöhnlich reich und anregend: der Versuch, von dieser Vielfalt durch einzelne Nachdrucke oder Berichte auch nur einen halbwegs repräsentativen Eindruck zu vermitteln, mußte scheitern. Dennoch haben sich die Herausgeber entschlossen, den hier folgenden Beitrag von CONARD aus der MICHIGAN LAW REVIEW (Vol. 82, 1984, S. 1459-1488) mit nur wenigen Kürzungen und Ergänzungen des Autors zu übernehmen: denn er behandelt aus der Sicht eines amerikanischen Kenners unter Berücksichtigung der Diskussion und Entwicklung in Europa die uns so vielfältig beschäftigenden Fragen von Leitung und Aufsicht, von Mitbestimmung und Arbeitnehmerbeteiligung und öffnet dadurch den Blick für neue Argumente.

Winnowing Derivative Suits Through Attorneys Fees

This article is written on the suppositions that the viability of shareholder derivative suits is a vital support to the U.S. free enterprise economy, that derivative suits are the major policemen of managerial integrity, and that without derivative suits, passive equity investment could not flourish.1 Other countries have other disciplinary devices,2 but the derivative suit is the preeminent disciplinary device in the United States.
