Gewährleistungsrecht als Erscheinungsform des Verwaltungsrechts

Gerold Ambrosius; Regulation of Public Services in historical perspective Europe; history; infrastructure; market forms; property rights; public services; regulation; unbundling The implementation of the European model of regulation of Public Services in the member states of the EU means in the case of Germany a fundamental reform of the regulatory traditions. Since the 19 century a regulatory regime was set up here based on (1) territorial monopolies, (2) mainly public enterprises, (3) steering under private law by franchise agreement, regulation under public law by act and decree and – after the Second World War – control of abusive practices by the Law Against Restraints of Competition. (4) In organisational respect this regulatory regime was founded on the administration of territorial authorities and not on independent commissions. The change of steering under private law in the 19 century to the regulation under public law in 20 century has numerous reasons – from the political federalism of the German Empire via the mismanagement of public enterprises to the mistrust of competitive markets of public utilities. The fact that Germany left this traditional path of regulation since the 1980 has many reasons as well. Offentliches Gewahrleistungsrecht thematisiert die Herausforderungen durch fortschreitende Marktliberalisierungen, kann aber nicht einfach auf die Idee eines steuerungsmachtigen Staates zuruckbezogen werden. Die Erganzung des ordnungsrechtlichen Eingriffsund des wohlfahrtstaatlichen Leistungsregimes hat vielmehr einer Steuerungsnaivitat vorzubeugen, die vom Staat der Zukunft mehr erwartet als das Recht der Gegenwart leisten kann.
