Basque and Catalan demands for legitimising political accommodation, solely on the basis of the democratic will of their residents, poses a significant challenge to the Spanish constitutional system. The core of the debate in this kind of conflict revolves around the so-called “right to decide” which commonly finds its expression in the capacity to hold a referendum over sovereignty matters. The path opened by Quebec, Scotland and other minority nations are considered by some to constitute evidence of the democratic need to include this right as a new accommodation formula. Incorporating a “sovereigntist proceeding” into the legal system(s) may pave the way to a new framework aimed at solving the significant constitutional problems that exist in Spain and other countries. I suggest that such a procedure could be incorporated and regulated in the existing legal systems and provide some guidelines that could be adopted when drafting the aforementioned regulation.

European States have been constructed on the assumption that homogeneity of culture and identity is natural and desirable. At the same time, European policies on immigration show a disproportionate emphasis on border control and the regulation of foreign workers, with little emphasis on cultural and identity integration and accommodation. Migrations also suppose a change of the traditional social and economic relations of any society, including the situation and perceptions of traditional minorities. This demands a new conception of diversity management and the need to reread the contents and exercise of fundamental rights. Inclusive citizenship and Multicultural democracy must become the two guiding principles of such a polity redefinition. A real frame of human rights cannot be created without incorporating a reference to identity and a minority approach. Today, we need a new reading of human rights based on the ideas of inclusiveness and diversity. This includes those languages, religions or cultures that have become part of the European multicultural heritage as a consequence of recent population movements.

Resumen: Desde los inicios del siglo XX la comunidad internacional ha intentado definir el concepto de minoría nacional en el Derecho Internacional, sin que hasta el momento haya sido posible alcanzar un consenso al respecto. Sin embargo, desde la creación de la Sociedad de Naciones hasta nuestros días se han delimitado una serie de elementos definitorios, que en las últimas décadas han sido consolidados por organismos internacionales, especialmente en el ámbito europeo. Entre ellos se incluyen, por un lado, elementos objetivos como la inferioridad numérica, la diferenciación cultural, étnica, religiosa o lingüística, la nacionalidad jurídica o ciudadanía del Estado de residencia y la temporalidad de la presencia en el territorio del Estado. Por otro lado, elementos subjetivos como la conciencia o identidad colectivas, y el deseo expresado por el grupo de preservar sus características específicas.

En el marco de las actuales sociedades multiculturales se hace necesario explorar vias de profundizacion democratica que permitan adaptar nuestros parametros juridicos tradicionales a la creciente y cambiante diversidad. El acomodo razonable se nos presenta como uno de los instrumentos juridicos que puede adquirir un importante protagonismo en este proceso de pluralizacion democratica. Desde la experiencia canadiense y quebequesa del acomodo razonable debe plantearse la posibilidad de importar a Europa este modo de flexibilizar el ejercicio de los derechos fundamentales en atencion a la diversidad cultural o identitaria. Esto implica plantear una critica a su funcionalidad puesto que aun no se ha demostrado la eficacia general de la tecnica del acomodo razonable aplicada a los distintos ambitos de la identidad humana, religiosa o linguistica.
