Scheming to defraud in an insolvency proceeding: a specific case of economic criminal acts

Abstract The article presents the theoretical foundations of the criminal act of scheming to defraud in an insolvency proceeding. A criminal act according to the § 226 Act No. 40/2009 Coll. (Criminal Code) is often a part of organized crime. Crime is made easier by the difficult proceedings of solving the debtor’s bankruptcy in the Czech Republic. The article includes a case interpretation in which the judge committed a crime. She caused severe harm to several participants of the insolvency proceeding and secured that the debtor’s shareholder benefited.

Financing of Terrorism

The issue of terrorism is becoming increasingly important on the level of social, economic, political and security. The threat of terrorism affects at the same time, societal and cultural events. Professional and academic discussion addresses the causes and possible consequences of this phenomenon. To understand the implications of terrorism, it is necessary to look at this issue from the perspective of terms of its financing. This review study aims to define the term financing of terrorism on the one hand, but also to identify possible sources of financing of terrorism, including the most used payment methods by terrorist organizations. This study also leads a discussion on the efforts and effectiveness of the various authorities in the fight for detecting terrorism, especially in relation to the detection of its financial flows. The study also defines the possible pitfalls in the fight against terrorism and detecting its sources of financing and attempts to outline possible alternatives while increasing success in this fight. Kooperace krajně pravicových a populistických stran v regionálních volbách

Předložený přispěvek se věnuje spolupraci krajně pravicových a populistických stran při regionalnich volbach. Text v teoreticke casti představi strany krajni pravice a strany v ceskem prostředi oznacovane jako populisticke. Diskutovana bude tzv. krajně pravicova stranicko – politicka rodina. Nasledně se text zaměři na popis volebnich výsledků v ramci jednotlivých krajů s důrazem na efektivitu vedouci k zisku mandatu. Zakladni kvantitativni metodou jsou variacni a korelacni analýza, pomoci ktere jsou sledovany vzajemne souvislosti volebni podpory. Dale se v textu pracuje se srovnanim regionalni odlisnosti omezovaci klauzule z pohledu absolutniho poctu hlasů. Výsledkem přispěvku je zhodnoceni schopnosti proměňovat hlasy na mandaty ve volenem tělesu a důrazem na volebni potencial sirsi skupiny krajně pravicových a populistických stran. Nechybi ani navaznost na financovani politických stran, protože za ziskane mandaty politicka strana ziska pravidelně financni podporu umožňujici dalsi cinnost.

Regionální aspekty volebního prahu krajských voleb v ČR

Předložený text pojednava o regionalnich aspektech volebniho prahu v krajských volbach v Ceske republice. Na konkretnich připadech jsou srovnany realne pocty hlasů nutných pro ziskani mandatu ve volenem zastupitelstvu mezi lety 2000–2012 s cilem přibližit regionalni odlisnosti. Vzhledem ke shodnemu vymezeni volebnich obvodů v krajských i sněmovnich volbach jsou porovnany take pocty hlasů v těchto typech voleb. Nechybi ani komparace možneho posunu v ramci kandidatni listiny vychazejici z možnosti udileni preferencnich hlasů v ramci listiny, opět mezi krajskými a sněmovnimi volbami. Hlavnim cilem je představeni volebniho prahu v regionalnim srovnani.

Regionalizace volebního chování s ohledem na podporu krajní pravice v ČR

Předložený přispěvek pojednava o regionalnich aspektech volebni podpory krajni pravice v ceských podminkach. Zakladnim předmětem výzkumu jsou volebni výsledky krajně pravicových stran agregovaných na urovni jednotlivých obci a nižsich spravnich obvodů. Datovou zakladnu mimo to představuji výsledky scitani lidu, domů a bytů, pomoci kterých jsou představeny regiony s vyssi podporou krajni pravice. Prostřednictvim statistických nastrojů jsou představen vzajemne vlivy a souvislosti s volebnimi výsledky dalsich politických stran.

Tento text řesi problematicke prvky při posuzovani extremisticke symboliky u přislusniků Ozbrojených sil Ceske republiky a snaži se na zakladě literatury upozornit na casto nesťastna hodnoceni symboliky. V žadnem připadě text neusiluje o snižovani významu teto problematiky en bloc, jde vsak spise o kritickou diskusi o teto poměrně nove problematice v prostředi ACR. Text vychazi z politologických a pravnických poznatků, ktere se věnuji krajni pravici a krajni levici, resp. jednotlivým symbolům.
