Judiciário: mudanças e reformas

THE JUDICIAL Branch of the Brazilian government, unlike in the past, is now in a not-so-flattering spotlight and no longer able to prevent changes. Reforms will come and changes are already happening, some more and some less visible, altering the identity and the profile of an institution that had always counted on tradition as an assured guarantee against innovation.

Poder Judiciário: perspectivas de reforma

The article discusses the crisis of the Brazilian System of Justice and some of the central aspects of its Reform propositions, like its anachronism, malfunctioning and the unequal access to the justice services. The author presents the positioning of Justice members about these issues based on survey researches conducted by the IDESP since 1993. Some of the survey results indicate that corporatism has diminished in the past recent years, what is expressed, for example, through the acceptance of democratization of the Justicial power. The results also show that the external control of the Judicial Power remains as one of the central problems.

OS BACHARÉIS EM DIREITO NA REFORMA DO JUDICIÁRIO técnicos ou curiosos

O artigo aponta a continuidade de uma tendencia que teve inicio no seculo passado: a predominância de bachareis em Direito na Câmara dos Deputados. Praticamente todos os partidos com representacao no Legislativo ¾ independentemente de sua posicao no espectro ideologico ¾ possuem em suas fileiras um grande numero de advogados. Este traco tambem nao distingue nenhuma regiao do pais. Alem disso, o predominio de bachareis em Direito foi criterio adotado pelos partidos para a constituicao da Comissao encarregada da reforma do Poder Judiciario.
