Conflicts and concertations on the use of littoral spaces in Corsica

Mediterranean littoral spaces are subjected to a strong tourist pressure which underlines the issue of conciliation between growth of built-up areas, on the one hand, and safeguarding of environment and agricultural activities, on the other hand. The tensions generated by these contradictory interests are particularly sensitive in Corsica, because a large part of coastal spaces still remain preserved and strictly protected. The present research is interested on two levels of regulation of these interests: judicial regulation by the administrative courts, relating to conflicts on a district level (building projects), and on the regional level, political governance through a public consultation procedure which focuses on planning law reforms. The inquiry shows how these two levels seems to be connected : the legal strategies of local representatives can be explained by characteristics of judicial regulation.

Testing the waters of coastal urbanization: Contested projects on Corsica's protected lands

ABSTRACT In the wake of the decentralization reforms implemented in France in the early 1980s, the Coast Protection Act (‘loi littoral’) was enacted in 1986 to counterbalance the significant regulatory powers devolved through those reforms to local municipalities in matters of urban planning. The act’s purpose was to contain urban sprawl, especially in heretofore undeveloped and protected areas such as those found on the Corsican coastline. Many local officials protested that the act would freeze any development on vast tracts of land and become a hindrance to carrying out potentially lucrative tourism projects on the most attractive coastal frontage parcels. The inquiry draws on a statistical sample of 252 legal arguments put forward in 180 claims, which were filed in the Corsican Administrative Court during the 2004–2011 period. From a sociological perspective, we examine in this article the strategies behind litigation and the use of the administrative courts as a means to resolve conflicts that have arisen over the attempted development of protected coastal areas. Special attention is paid to disputes over proposed development projects against which claims have been filed by local inhabitants and state administrators with the intention of containing urban sprawl.

Introduction : Conflits d’usage dans les espaces ruraux et périurbains

La multiplication des travaux sur l’action publique et les reseaux d’acteurs locaux contribue a placer les enjeux de gouvernance au coeur de la dynamique des territoires, en mettant l’accent sur les structures de pilotage des actions collectives, ainsi que sur les processus de negociation et de concertation pouvant s’initier entre les parties prenantes du developpement. Toutefois, les analyses des phenomenes de conflictualite comme elements constitutifs de cette dynamique restent encore insuffisamment nombreuses, et l’accent exclusivement porte, le plus souvent, sur les processus de cooperation. Or, les conflits d’usage des espaces font a bien des egards partie integrante de la vie publique locale et des relations de voisinage dans les territoires ruraux et periurbains, quelle que soit la forme que revet leur expression : oppositions entre voisins, prises de parole et mediatisation, pressions aupres des elus et de l’administration, interventions d’associations, demandes adressees aux juridictions. Ils se revelent comme des moments incontournables de la vie des territoires et des processus de developpement, avec leurs avancees et leurs resistances.
