Après Durban, quelle structuration juridique pour un nouvel accord international sur le climat ?

Le Protocole de Kyoto n’impose pas aux Etats parties d’obligations chiffrees de reduction des emissions au-dela d’une premiere periode d’engagement prenant fin en 2012. La forme et le contenu des engagements pour une deuxieme periode d’engagement restaient donc entierement a definir. Les negociations du « post-2012 » ont demarre des 2005, des l’entree en vigueur du Protocole. En 2007, les Parties ont ouvert en parallele une deuxieme voie de negociation, cette fois dans le cadre de la Convention, pour preparer un accord international plus global, amenant tous les grands pays emetteurs a reduire leurs emissions de gaz a effet de serre. Cet accord devait pouvoir etre en vigueur en 2013, a l’issue de la premiere periode d’engagement du Protocole. Or, ni la Conference de Copenhague en 2009, ni la Conference de Cancun en 2010, n’ont represente l’aboutissement des negociations. Elles n’ont pas tranche les questions delicates que sont le sort du Protocole de Kyoto, la forme juridique et l’architecture du futur regime post-2012, qui ont ete au centre de la Conference de Durban. Cette conference y a apporte une reponse en forme de compromis. La decision a ete prise de continuer le Protocole pour une deuxieme periode, mais egalement de lancer les negociations pour un nouveau regime, plus inclusif et plus ambitieux, qui devrait etre en place a partir de 2020.

After Durban, What Legal Form for the Future International Climate Regime?

The first commitment period of the Kyoto Protocol is due to expire at the end of 2012, but no commitments have been adopted to date for a second period. Discussions about the fate of the climate regime beyond 2012 were supposed to end in 2009, in order to avoid a gap between the first and second commitment periods. But neither the Copenhagen climate summit (2009), nor the Cancun conference (2010) resulted in conclusion of a deal. They did not yield answer about the divisive issues of legal form and architecture of the future international climate regime. The Durban Conference (2011) no longer was able to avoid addressing these thorny issues. At the very end of the summit, a compromise was reached following long and difficult negotiations. Parties decided to extend the Kyoto Protocol through a second commitment period and launch a new round of negotiations under the Convention in order to adopt a more inclusive and ambitious international climate regime to be implemented from 2020.
