A European Story

The decision of the Supreme Court in RJR Nabisco v. European Community is the culmination of sixteen years of litigation, preceded by years of investigation. From a European perspective, the decision can only be read as a disappointment: “we” tried, “we” lost. But beyond the frustration with the outcome, this European take on the RJR decision will focus on two questions: (i) why did the European Community decide to bring proceedings in the United States in the first place; and (ii) what would happen in the reverse scenario, if a foreign public authority or a private plaintiff were to bring suit in the European Union? Answering these two questions casts RJR in a slightly different light and offers an interesting picture of the wider political and regulatory context in the European Union.

Das Belgische IPR-Gesetzbuch

Am 16.7. 2004 hat der belgische Gesetzgeber sein erstes Gesetzbuch uber das Internationale Privatrecht erlassen. Vor dem Inkrafttreten dieser umfassenden Kodifikation am 1.10. 2004 enthielt das belgische Recht nur vereinzelte und verstreute kollisionsrechtliche Vorschriften, und das IPR war in erster Linie ein Konstrukt der Rechtsprechung. Diese der franzosischen Tradition entstammende richterrechtliche Losung, die sich in Europa zunehmend isoliert sah, war bereits zweimal mit Reformvorschlagen – erfolglos – in Frage gestellt worden: Zum einen hatte Francois Laurent bereits 15 Jahre vor dem Inkrafttreten des EGBGB in seinem Vorschlag zur Reform des Code civil (C.civ.) 16 Artikel uber das IPR aufgenommen; zum anderen hatte das nie in Kraft getretene Benelux-Ubereinkommen vom 3.7. 1969 zur Vereinheitlichung des IPR die Kodifizierung des belgischen IPR zur Folge gehabt . Das Gesetz vom 16.7. 2004 stellt eine Art Revolution fur das belgische IPR dar, welches nun, auf eine lange Tradition aufbauend, im Zeichen der Modernisierung steht.
