Tearing the Veil of Privacy Law: An Experiment on Chilling Effects and the Right to Be Forgotten

Privacy law relies on the argument that consent does not entail any relevant impediments for the liberty of the consenting individual. Challenging this argument, we experimentally investigate whether consent to the publication of personal information in cyberspace entails self-coercion on a social norm level. Our results suggest that the monetary benefits from consent constitute a price that people are willing to accept for increased compliance with social norms. Providing people with a prior consent option is sufficient to generate chilling effects (i.e., a reduction of norm-deviant behavior). However, nudging people towards potential publicity does not increase the value they place on privacy. We also test how the default design of the right to deletion of personal information (right to be forgotten) affects chilling effects and privacy valuations. Surprisingly, the right to be forgotten does not reduce chilling effects. Moreover, individuals tend to stick with the status quo of permanent information storage.

Debarment and Collusion in Procurement Auctions

This article presents the first experiment exploring the impact of debarments - the exclusion of colluding bidders - on collusion in procurement auctions. We find that debarments and their most common alternative, fines, reduce collusion and bids relative to a market with no sanction. The deterrent effect of debarments increases in their length. However, shorter debarments reduce efficiency and increase the bids of non-debarred bidders. This suggests that debarments that are too lenient may trigger tacit collusion among the bidders who remain in the market, thereby facilitating the very behavior they aim to deter.

Lernspiele vermitteln Informationen und trainieren neue Verhaltensweisen an. Im Vergleich zu herkömmlichen Therapieansätzen lassen sich deutlich überlegenere Wirkungen von Computerspielen feststellen, da die Folgen einer Handlung direkt sichtbar werden (unmittelbares Feedback). Dies wiederum fördert die Compliance. Im 3-DShooter Spiel „Re-Mission“ beispielsweise steuern an Krebs erkrankte Kinder und Jugendliche einen Roboter durch ihren Körper und schießen mit Medikamenten böse Krebszellen ab. Eine klinische Studie konnte zeigen, dass dieses Spiel die Konzentration von Chemotherapeutika und Antibiotika im Blut der Teilnehmer steigert, das krankheitsrelevante Wissen verbessert und die Selbstwirksamkeitserwartung der Patienten erhöht.26
