ABSTRACT In the fast growing fitness industry the use of scientific organization of work might suggest a backward trend. These managerial practices are also associated with franchising as a business model. It is paradoxical because the industry is averse to the practices and to the business model as well because the fitness is valued as an artistic activity where personal skills, sometimes considered inborn, such as individual gifts and creativity should predominate. The main goal of this article is to answer the following question: are scientific organization of work, creativity and innovation compatible at all? The attempt to answer was made possible by visiting many websites, interviewing people and observingthe fitness businesses. It was found that at the organizational level the scientific organization of work is a limitation to creativity and innovation, but not eliminating them entirely. Thus the paradox remains and might bring further developments. KEYWORDS Scientific management, franchising, globalization, fitness, market.

This paper discusses the main theoretic arguments that sustain the subcontracting decision by firms. It also reports a fieldwork conducted in Rio Grande do Sul, Brazil, that tries to verify how such theoretical concepts work in practice. Secondary data were collected on business magazines and scientific journals. These data reinforce the authors argument that subcontracting should not be considered as a general tendency, because in some cases it may be unprofitable, raising costs, reducing quality, increasing uncertainty concerning products and delivery schedules. Moreover, when the technology is the advantage of a company, subcontracting may reduce its competitive power.

The division among the legislative, executive and judicial functions, as well as among the activities necessary to administrate the State in an environment of res publica, known as division of powers, with mutual tasks but not exclusively to each one, is an old lesson left by Montesquieu. In the Brazilian case, although the 1988 FC is considered as being the Citizenship Constitution, it presents problems of origin, being the fact of having adopted a presidential form of government but having attributed to the Congress competences appertaining to parliamentary systems the major one. Such a design, per se full of contradictions, allied to the tradition and the weight of the civil vis-a-vis the uses and costumes law and, although being a Federate State, results in an excessive amount of competences in the Unions hands. Having in sight these vices and contradictions, this paper discusses, based on a bibliographic research and secondary data, how the interdependency among the three Powers resulted in an out of control process of usurping the attributions and competences one from the other. Thus, a basic tableau is presented establishing the main points of Montesquieus postulations and how these aspects are present in the tripartite model of government, namely presidentialism, highlighting the peculiarities of the Brazilian context, emphasizing some important institutional aspects of the national political system: multipartidarism in a bicameral federal system; the great number of parties; the difficulty of, as the result of a popular consultation, a single party getting a majority in both parliamentary houses; functional-physiological parliamentary alliances; and the parties national character. Afterwards, some examples are discussed on how the Executive usurps the legislative power via Provisional Measures which end up clogging the Legislative agenda, although the Constitutional text postulates that the usage of this instrument be only in cases of urgency and of relevance; how the Judiciary also ends up legislating because of the Parliaments omission in important matters; and as how the Judiciary not only press the Executive to establish and implement action strategies, as well as assumes actions that are of its original competency. The scenario, as it can be perceived, is quite complex; in this environment, the interferences of a Power upon the dominions of another are much more consequence than original fact. This impact heavily upon the formulation and implementation of public policies, as has been shown by the divulgence about what is happening in the areas of health and the execution of the liberty restricting penalties in prisons. The tripartite model postulates the equilibrium among the powers, with neither concentrating nor having an absolute separation among them, which is not being the case nowadays in the country.

Despite some differences, the domains of Literature and Management have overlapping areas, which enables the use of one of them (in this case, Literature) to study and widen the knowledge on the other (Business). The present article aims to show some of the contributions from the arts to organizational studies and reporting and sharing the experience of the Literature & Management Project with the academic community, as well as offering critical comments on it. The Project, through the reading and analysis of selected texts, is not only intended to be another source of knowledge acquisition, but also to develop and enhance competencies required for future professional activities of the Business School students. Although the focus has been the teaching and learning process for university students, it can be expanded to the corporate environment, where it can be developed as seminars and role-playing activities. This represents a wide field that has not yet been fully explored.

O presente trabalho objetiva avaliar a atuacao dos tutores do Curso de Especializacao em Negociacao Coletiva (NEGCOL-EA/UFRGS), ofertado na modalidade a distância. A justificativa deste estudo visa aperfeicoar o papel desempenhado pelo tutor no processo de ensino-aprendizagem mediado por TICs. Na discussao teorica sao apresentadas nocoes conceituais acerca do papel dos tutores no processo de ensinoaprendizagem mediado por tecnologias, bem como da importância da avaliacao da atuacao dos mesmos. Em termos metodologicos, realizou-se um levantamento com delineamento exploratorio-descritivo, sendo que os dados foram coletados via web com 288 alunos, cujas respostas foram analisadas por meio de estatisticas simples. Tambem se fez uso de dados secundarios. Os principais resultados indicam que a avaliacao do desempenho dos tutores, tanto nas avaliacoes reativas dos alunos ao final das disciplinas, como na avaliacao final do curso, foi bastante positiva. Ha fortes indicios de que a estrutura de tutoria adotada pelo curso tenha contribuido para o bom desempenho dos tutores. Na avaliacao pela coordenacao do curso fica em aberto a questao quanto ao modelo de estruturacao da tutoria, se por disciplina ou permanente, tendo em vista que no caso do curso foi uma mescla de ambos os modelos.

O presente trabalho objetiva apresentar as perspectivas dos alunos, tutores e professores orientadores acerca do processo de construcao do trabalho de conclusao de curso na modalidade a distância, atraves de uma pesquisa realizada nos cursos de graduacao em Administracao e especializacao em Negociacao Coletiva ofertados pela Escola de Administracao da UFRGS. Adotou-se a estrategia de estudos de casos multiplos, sendo que os dados foram coletados atraves de questionarios e entrevistas e foram interpretados com base na analise de conteudo. Dentre os principais resultados apresentados pelos alunos para a elaboracao do trabalho final, destacam-se: escassez de tempo para conciliar as atividades do curso com outros compromissos; dificuldade de compreensao e de uso das normas tecnicas; problemas de relacionamento com tutores e professores orientadores, sob a alegacao de que a distância fisica interferiria de forma prejudicial no processo de orientacao; dificuldade em redigir textos cientificos; obstaculos para acesso ao campo de pesquisa e para o acesso a materiais bibliograficos, entre outros. Os professores orientadores e tutores, por sua vez, sugeriram novas possibilidades de atuacao para minimizar as dificuldades e otimizar o processo de construcao do trabalho de conclusao de curso.
