Remaining Scopes for Collective Management of Copyright in the Online World

The online world seems to enable creators and other rights holders to know who the users of their works are as well as to control their use. This may involve a shift of the role of collective management organizations towards a decrease of their scope of activity. This chapter defines collective management of copyright as it developed until today, and questions the decrease of the role of collective management of copyright considering the current developments.

The Balance of Copyright

This report considers the respective rights to be accorded the holders of copyrights and the users of their works. These interests have been considered in the TRIPS Agreement of 1994, the WIPO Treaty of 1996 regarding copyright, and the Berne Convention, all of which apply to many of the countries covered. Other fundamental rights, such as freedom of speech, expression, and competition, bear upon the appropriate balance of the different categories of rights holders. The reporters note that the lack of differentiation among different categories of works results in overprotection over some which impedes uses that lie in the public interest. Free-of-charge user rights exist for certain categories of consumers, to fulfill educational and cultural needs, but some countries that strongly support rights of the author resist the notion of a gratuitous license. Prospects for reform lie in the implementation of articles 7 and 8 of the TRIPS Agreement with an eye toward a balancing of rights and obligations to the mutual advantage of producers and users.

Bericht von der Abschlussveranstaltung der deutsch-französischen Vortragsreihe zum Urheberrecht

Am 13. Januar 2006 fand im Europaischen Patentamt eine vom Max-Planck-Institut fur Geistiges Eigentum, Wettbewerbs- und Steuerrecht, Munchen, und dem Institut de Recherche en Propriete Intellectuelle, Paris, in Zusammenarbeit mit dem Bayerisch-Franzosischen Hochschulzentrum und der Ambas-sade de France en Allemagne organisierte Tagung zum Thema „Urheberrecht im deutsch-franzosischen Dialog — Impulse fur eine europaische Rechtsharmonisierung“ statt. Bei dieser Tagung handelte es sich um die Abschlussveranstaltung einer von September 2004 bis Dezember 2005 durchgefuhrten Vortragsreihe zu ausgewahlten problematischen Themen des Urheberrechts. Die Auswahl der Themen orientierte sich teilweise an Bereichen, die auf europaischer Ebene noch nicht einer Harmonisierung zugefuhrt worden sind. Der Kreis der Teilnehmer dieser Tagung bestand aus renommierten Experten aus Frankreich und Deutschland im Bereich des geistigen Eigentums, Praktikern und Interessenvertretern aus beiden Landern sowie einer Vielzahl von jungen, auf dem Gebiet arbeitenden Wissenschaftlern.
