Psicologia jurídica e tomada de decisão em situações envolvendo abuso sexual infantil

This paper presents a theoretical review on decision making in situations of alleged child sexual abuse. Mental health professionals around the world need to make decisions about the veracity of these claims, many being wrongly judged. This article presents sexual abuse as a global problem, highlights the relationship between psychology and justice, and approaches studies that demonstrate the influences of variables such as cognitive biases, prior beliefs and gender on the decisions taken by professionals who assess these cases. It is essential that professionals recognize these variables so that errors on these trials could be avoided and the quality of forensic psychological assessments could be increased. The need for experience and scientific knowledge is discussed as a possible contributor to the qualification of psychologists working in this area and researches on this subject within the Brazilian context are suggested.

Do segredo à possibilidade de reparação: um estudo de caso sobre relacionamentos familiares no abuso sexual

Este estudo investigou como uma adolescente vitima de abuso sexual intrafamiliar percebe sua familia em termos de coesao, hierarquia, afetividade, conflito e relacoes de identificacao. Trata-se de um estudo de caso, do qual participou uma menina de 13 anos, que sofreu abuso sexual perpetrado por seu pai. Foi realizada a entrevista semi-estruturada e a aplicacao dos instrumentos Familiograma - FG, Family System Test – FAST e Family Identification Test – FIT . Os resultados demonstraram a presenca de alcoolismo e violencia anterior por parte do abusador, ambivalencia da pessoa autora da denuncia e incidencia de violencia fisica e psicologica, alem da sexual de maus-tratos. Alem disso, a menina evidenciou relacoes pouco afetivas e muito conflituosas com o abusador e relacoes mais significativas com a madrasta e alguns irmaos. Para a menina, a madrasta e tambem um modelo identificatorio mais forte do que o pai. Pode-se concluir, a partir das percepcoes da adolescente, que o casal parental apresentava relacionamento conflituoso e pouco afetivo e que a familia se caracterizava por relacoes desequilibradas e instaveis. Estudos sobre familias em que ocorre abuso sexual sao escassos no meio cientifico e tornam-se extremamente necessarios, pois podem ampliar o conhecimento sobre o assunto e prover subsidios para as intervencoes dirigidas a essa populacao. Depoimento especial : para além do embate e pela proteção das crianças e adolescentes vítimas de violência sexual

The Judiciary Inquiry method of testimony for children and adolescents who suffered sexual abuse, called special testimony, has been discussed by professionals and there are divergent opinions about it. This article aims to present historically the Special Inquiry method that has been used in Brazil, fi rstly named Testimony without Damage, and discuss the needs of the area for a better direction of this activity. As contribuições da Psicologia para o sistema de justiça em situações de abuso sexual

This work analyzed the perception of the legal system operators on the role of Psychology in cases of sexual abuse, the elements that influence their decisions and the possibilities for enhancing contributions from Psychology. Fifteen professionals from the State of Rio Grande do Sul legal system (five judges, five legal aid counselors, and five public attorneys). Data were submitted to content analysis with the support of webQDA software and they revealed that Law operators agree on the importance of the role of Psychology in those cases, both in view of possibilities of sexual abuse evidencing and on protecting the victim and family. Limitations of the legal courses were pointed out as one of the reasons for the referral and of the importance of Psychology. Documents, testimonies, and subjective perceptions appear influencing decisions made by those operators. The operators report that, for a greater contribution of Psychology to Justice, higher attention to defendants and more consistent documents would be necessities of the field. Dialogue and communication are presented as means for the approximation of Psychology and Law, and as qualification to ensure the rights for those who are victims of violence.

Tomada de decisão de psicólogos em situações de suspeita de abuso sexual

Decision making in sexual abuse situation is a complex task involving different sources of information as well as non-obvious or subjective infl uences. The decision made by a professional can produce relevant consequences for the people involved. An online survey with 95 Brazilian bachelors in Psychology was conducted and it evaluated the decision-making in a fi ctitious case of sexual abuse and its relations with cognitive, sociodemographic and professional variables. In addition, the infl uence of the presence of representative characteristics of cases of sexual abuse in decision-making by professionals was evaluated from the Decision Making Scale in Child Sexual Abuse, an instrument developed for this study. Age, gender, time of graduation and time of practice did not correlate with the decision made about the case. However, representative characteristics of sexual abuse had signifi cant relations with the evaluated probability of the case. This result means that the probability of the case being considered true is higher when more representative characteristics has the case. Decision-making in these situations, despite being carried out by professionals every day, is still unknown and deserves further investigations.

A Humanização do Sistema de Justiça por meio do Depoimento Especial: Experiências e Desafios

O Depoimento Especial (DE) e uma pratica de escuta de criancas e adolescentes vitimas de abuso sexual que objetiva minimizar os danos causados por recorrentes testemunhos. O objetivo deste trabalho foi verificar a percepcao de trabalhadores do Poder Judiciario sobre o DE, com foco na atuacao do psicologo, a partir de entrevistas com 20 profissionais do Estado do Rio Grande do Sul com experiencia nesse metodo. A analise de conteudo das entrevistas, com apoio do software webQDa, evidenciou tres categorias (Papel do entrevistador, Funcoes do DE e Condicoes tecnicas). Os resultados indicaram que diferentes profissionais podem exercer essa atividade e que a autonomia do entrevistador e dependente dos operadores com quem trabalha. O DE possui as funcoes tanto de comprovacao do fato como de protecao e a experiencia tem propiciado o aperfeicoamento do metodo, ainda que sejam necessarias melhorias. O DE e um metodo em construcao, dependente de seus trabalhadores e pleno de possibilidades de aperfeicoamento.
